Highly Capable Program Framework

Washington State’s Highly Capable Program is guided by three connected sources of authority and guidance:

Statutes (RCW)
The Revised Code of Washington (RCW) contains the laws passed by the Legislature. These statutes define key terms such as “highly capable,” establish minimum program requirements, and set legal obligations for school districts.

Regulations (WAC)
The Washington Administrative Code (WAC) contains the rules adopted by the Office of Superintendent of Public Instruction (OSPI) and other agencies. These regulations provide the detailed procedures schools and districts must follow to implement the RCWs.

Program Guidance & Resources
The Office of Superintendent of Public Instruction (OSPI) also issues program guidance and resources for educators and families. While not law, these materials interpret the statutes and regulations, offering clarity on expectations and best practices. Guidance often addresses topics such as equitable identification, instructional models, and program accessibility.
